These terms define the rules for using Terra Fauna. The central rule is simple: no capture, reward, or game objective is worth disturbing wildlife or putting anyone at risk.

1. Agreement to these Terms
These Terms of Service (“Terms”) are an agreement between you and the operator of Terra Fauna (“Terra Fauna,” “we,” “us,” or “our”). They govern your access to the Terra Fauna website, iOS application, accounts, capture system, and related services, collectively the “Service.”
By creating an account, downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. These Terms apply to all users of the Service. If you do not agree, do not create an account or use the Service.
If you download the app through Apple’s App Store, Apple’s applicable licensed-application terms also apply to the app binary. These Terms separately govern Terra Fauna accounts, gameplay, and online services.
2. Eligibility and accounts
You must be at least 13 years old to create an account. If the minimum age for consenting to an online service in your country is higher, you must meet that age unless Terra Fauna provides a legally compliant parental-consent experience. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you.
You agree to provide accurate information, use only your own Sign in with Apple credentials, protect access to your device and account, and notify us promptly if you suspect unauthorized use. You may not sell, rent, share, or transfer an account.
You are responsible for activity performed through your account except to the extent caused by Terra Fauna’s failure to use reasonable security. We may require account verification or deny account creation where necessary for security, legal compliance, or Service integrity.
3. Limited license
Subject to these Terms, Terra Fauna grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the app on Apple devices you own or control for noncommercial, personal use.
This license does not permit you to copy, redistribute, sell, sublicense, publicly perform, reverse engineer, bypass security controls, extract protected assets or models, create derivative commercial services, or use the Service in a way not expressly allowed by law or these Terms. Rights not expressly granted are reserved.
4. Captures and gameplay
Live observations only
A reward-eligible capture must be a short live video recorded inside Terra Fauna. Imported photos, prerecorded video, photographs of screens or printed images, toys, taxidermy, staged subjects, and manipulated media are not valid wildlife captures.
Verification
A capture may be accepted only if the Service can verify a supported species at sufficient confidence, obtain a fresh qualifying location sample, confirm that the location is eligible, and determine that the same account has not already captured the same species within the applicable duplicate radius. A user guess may contribute only as described in the game rules and cannot override weak visual evidence.
Restricted locations
Captures are unavailable in or near reviewed zoos, aquariums, safari or wildlife parks, petting zoos, and similar captive-animal facilities. Boundary data can be incomplete or change over time. There is no right to a reward because an animal or location appears eligible, and a boundary decision does not authorize entry onto any property.
Teams, stats, and progression
Earth, Air, Fire, and Water team choices are permanent under the current game rules. Deferring a choice may reduce XP until you select a team. Species rarity, quality bands, animal stats, XP, food, duplicate distance, and other rules are game mechanics. We may balance or version these systems prospectively. Previously awarded values may remain tied to the rules in effect when a capture was accepted.
Classification is fallible
Animal identification is automated and can be wrong. Terra Fauna is a game, not a scientific survey, veterinary service, wildlife-management authority, safety tool, or emergency service. Never touch, handle, eat, approach, or make a safety decision about an animal based on a Terra Fauna result.
5. Wildlife, personal, and property safety
You are solely responsible for your conduct and surroundings while using the Service. You agree that you will:
- observe from a safe distance and never touch, feed, chase, corner, bait, trap, relocate, or intentionally disturb wildlife;
- stop recording if an animal changes behavior, appears stressed, approaches you, or attempts to leave;
- remain aware of traffic, terrain, cliffs, water, weather, fire, other people, and other hazards;
- obey closures, posted rules, permits, wildlife protections, park regulations, and instructions from authorities or land managers;
- not trespass or enter restricted, unsafe, or private property without permission;
- not operate a vehicle, bicycle, vessel, or dangerous equipment while interacting with the Service; and
- avoid revealing or encouraging visits to sensitive nests, dens, breeding areas, threatened species, or vulnerable habitats.
If the app, an animal, a sign, a land manager, or common sense tells you to stop or move away, do so. A closer or longer video does not justify risk or interference.
6. Your video and capture information
You retain any rights you have in videos you record. The original video remains in protected storage on your device and is not uploaded to Terra Fauna. You authorize on-device analysis of selected frames and transmission of the resulting identification, quality, integrity, location, and gameplay metadata as described in the Privacy Policy.
You grant Terra Fauna a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and use account and capture metadata only as necessary to operate, secure, improve, and provide the Service; enforce these Terms; and comply with law. This license ends when the relevant data is deleted, except for information lawfully retained in backups, security records, or de-identified form.
You represent that you have the right to create each recording and that your use does not violate privacy, property, intellectual-property, wildlife, or other laws. Avoid recording identifiable people, private conversations, private spaces, vehicle plates, addresses, or other unnecessary personal information.
7. Acceptable use and fair play
You may not:
- spoof, simulate, falsify, replay, or manipulate location, time, device, camera, species, or capture evidence;
- submit media that was not recorded live through the authorized capture flow;
- circumvent duplicate checks, facility exclusions, species support limits, App Attest, rate limits, or other technical controls;
- use bots, automation, modified clients, emulators, unauthorized APIs, scraping, or reverse-engineered protocols;
- probe, scan, disrupt, overload, or gain unauthorized access to the Service or another account;
- harass others, coordinate unsafe activity, encourage trespassing or wildlife disturbance, or use the Service for unlawful surveillance;
- infringe intellectual-property, privacy, publicity, or other rights; or
- help another person do any of the above.
We may invalidate captures or rewards, restrict features, suspend accounts, or preserve relevant security records when we reasonably believe these rules were violated.
8. Virtual items and game value
Animal stats, XP, food, teams, levels, captures, inventory, and other game elements are limited licenses to use features within Terra Fauna. They are not property, currency, stored value, investments, or redeemable for money or goods. They cannot be sold, traded, transferred, inherited, or used outside the Service unless we expressly introduce a feature that says otherwise.
The Service does not include purchases, subscriptions, advertising, or paid virtual currency. If paid features are introduced, additional purchase terms and legally required disclosures will apply before you buy them.
9. Availability, changes, and third parties
The Service may be interrupted, delayed, unavailable, geographically limited, or changed. Animals move; networks fail; location and map data can be inaccurate; classifier support is intentionally bounded; and a supported species may still fail verification. We do not promise that a particular capture, species, location, reward, or local video will remain available.
We may add, remove, balance, suspend, or discontinue features and supported species. When reasonably practical, we will provide notice before a material discontinuation. We are not required to preserve game mechanics, rankings, values, unsupported data, or local media indefinitely.
The Service relies on third-party services such as Apple and Supabase. Their services and terms are outside our control. Links to third-party websites are provided for convenience and do not imply endorsement.
10. Terra Fauna intellectual property
The Service, Flowing Stag mark, interface, software, species catalog structure, game rules, text, illustrations, audiovisual materials, and other Terra Fauna content are owned by Terra Fauna or its licensors and are protected by intellectual-property laws. Species facts and public-domain taxonomic information remain subject to their respective legal status, but their selection, presentation, and associated original work may be protected.
If you send ideas or feedback, you grant Terra Fauna a perpetual, worldwide, irrevocable, royalty-free right to use and adapt that feedback without restriction or compensation. Do not send confidential information through feedback channels.
11. Suspension, termination, and account deletion
You may stop using Terra Fauna at any time and may request account deletion through the app. Signing out does not delete the account or device-local video. Account deletion removes server account data as described in the Privacy Policy and separately lets you address local video where technically available.
We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, abuse wildlife or other people, compromise Service integrity, or if continued service is no longer commercially or technically reasonable. Where appropriate and legally required, we will provide notice and an opportunity to appeal.
Sections that by their nature should survive termination—including ownership, disclaimers, limitations of liability, dispute terms, and obligations arising before termination—will survive.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Terra Fauna disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, secure, error-free, scientifically accurate, compatible with every device, or that defects will be corrected. We do not warrant animal identification, location boundaries, rarity, safety guidance, capture eligibility, or preservation of device-local videos. Nothing in the Service is professional scientific, medical, veterinary, legal, navigation, emergency, or wildlife-management advice.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Terra Fauna and its affiliates, service providers, licensors, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, local videos, goodwill, profits, or opportunities; personal injury or property damage arising from unsafe conduct; or losses resulting from wildlife encounters, location errors, third-party services, unauthorized access, or Service interruption.
To the fullest extent permitted by law, Terra Fauna’s aggregate liability arising from the Service or these Terms will not exceed the greater of US $100 or the amount you paid Terra Fauna during the twelve months before the event giving rise to the claim.
These limits do not apply where liability cannot lawfully be limited, including rights that cannot be waived under applicable consumer law.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold Terra Fauna harmless from third-party claims, damages, and reasonable costs arising from your unlawful conduct, unsafe wildlife interaction, trespass, rights infringement, fraudulent captures, or material violation of these Terms. This obligation does not apply to the extent a claim results from Terra Fauna’s own unlawful conduct.
14. Governing law and disputes
These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles, except where the mandatory law of your residence requires otherwise. Any dispute that is not eligible for small-claims court will be brought in an appropriate state or federal court in California, and each party consents to personal jurisdiction there, unless applicable consumer law provides another forum.
Before filing a formal claim, please contact us and describe the issue. Both sides agree to make a good-faith attempt to resolve the dispute informally for at least 30 days. This paragraph does not prevent either side from seeking urgent relief for security, safety, or intellectual-property misuse.
15. General terms
If any provision is unenforceable, it will be enforced to the maximum permissible extent and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, sale, or transfer of the Service.
These Terms, the Privacy Policy, and any feature-specific terms form the entire agreement about the Service and replace prior discussions about their subject matter. Section headings are for convenience only.
We may update these Terms as the Service evolves. We will post revised Terms and update the effective date. If changes materially affect existing users, we will provide additional notice where reasonably required. Continued use after revised Terms take effect constitutes acceptance; if you do not agree, you must stop using the Service.
